With that spring, and that size turbo, your wastegate could be too small. It is vented to the atmosphere though, so that should help like Rick said. The guys at Precision recommended I upgrade from the 38mm when I upgraded to a pt76 at 10#. My old setup was creeping at one point, but it was because I had the hoses hooked up backwards to my controller.

LOL, yeah, I've made the VE and BE changes so its plenty safe now, I'd like about a 11psi spring instead of this one for just that reason. if I can make it hit right around 9psi, and then it ends up creeping up to a hair over 10 it won't be an issue, I've been planning 10psi on the street anyway, and 15 for track days. First time on the track will be with this wastegate only and no controller so we will see what it does. Should give me a better baseline...

No controller might help your creep, before I had a controller I couldn't build as much boost. I was reading in my wastegate manual that the degree position of the wastegate on the pipe can affect the flow. Mine's not in a very good spot but It has seemed to work. Hopefully you get yours figured out.

Solved!
The WG was mounted on a flex joint and the guts had come undone and stopped up the WG flange. I cut the flange and flex joint off and welded the flange directly onto the crossover and mounted it all back up.... Goes right to 10psi and stays put
10#'s is oficially "low boost"
