Default damn it!!!!!!! what is up?????

I have not even done the first oil change yet and another accident. This truck is trying to kill me.

Wife backed into it the first month.......

Left across traffic got the front bumper.

Tonight on the way home, I am sitting stopped in rush hour traffic on a narrow two lane street. a large city bus decides theres enough room to squeeze by. NOT. SO F&*%$#G NOT!!!!!

Rips my driver mirror off and gets into the fender flare. I just knew it had gone all the way down the side, but it didn't. May have to buff the door where the mirror swung around and hit it, but no metal work...

the bad thing is any city veh has soviergn immunity
cant claim anything against them
Why they drive like asses
nothing can happen to them.

good thing is the damage is not too bad
but if it was - you would be out your deductible.
and youd be fixing your truck.

Why can't he claim it against the city? My sister's car was damaged by a bus' blown tire and she was able to claim.

Most cities - the fire dept, police dept, cities buses, schools, have ammunity. If they hit you - you have to use your own insurance policy and pay your deduct and will be unable to collect.
Unsure with your sister. Smaller city ?? not sure...
If it is city owned property - typically they have ammunity.
Privately owner company that is sub contracted by the city would not.
Could this be your sisters situation.....??
Typically what I run into... if it is city owned - you are SOL.
Hope this helps.

Not so...The city still retains liability for it's workers/vehicles. There's no such thing as city immunity. Hell, if that was the case, I'd hire on with the city and ram into a few vehicles of my not so good "friends" and then quit....IMMUNITY.

NOT quite.

Why do I hear of so many lawsuits against police, schools, cities, etc if they were immune??

BTW, I have had a friend put into the hospital b/c a cop hit her, totaled her car, etc. She's not one to sue for millions, but she got all her bills taken care of, lost wages, new car, all from the city.

Red
Not going to debate with you
I do this for a living - I run the process for an entire state.
My girl - does the same thing for a living
I am with a Fortune 500 company
She is with a Fortune 500 company
She and I do this everyday and deal with this everyday
Not trying to bust on you - but I know what I am talking about.
Would not post it if it was not true.
Does not mean you cant sue em - two different things.
Here is something for you to read - hope it helps.......
Law school stuff...

Sovereign immunity is a legal doctrine which, under some circumstances, protects the federal, state, and tribal governments within the United States from lawsuits which would cause those governments to pay out money, real estate, or goods from the governmental treasury. The basic idea behind sovereign immunity is that property held by the government (including assets in the public treasury) is in trust for all the citizens of that particular government. The public treasury and public property are, therefore, to be used for the benefit of all the citizens equally--not jut a few individuals (such as the people who file lawsuits). If, through lawsuit, a plaintiff can collect money from the government for some wrong the government has done him, the public treasury will be reduced for the benefit of that one person. There will then be less money to provide services to all the other citizens of the government. All the citizens will suffer because of the drain on the public treasury caused by a single citizen.

Courts have said that when someone claiming to have been injured by the government or its employees files suit for money damages against the government, and the government has not expressly waived its immunity, the court will not even consider the lawsuit. Instead, the court will dismiss the suit and instruct the injured person to seek payment for his injuries from the legislature or chief executive of the government. The government, say the courts, is immune from any lawsuit seeking money damages against it. Because the legislative body and the chief executive are the elected representatives of all the people, only they should decide where public money (and other property) belonging to all the people should be spent. This is not a decision for the courts.

Many state supreme courts over the last decade have limited or abolished the defense of sovereign immunity, by finding that the doctrine was court made, and declaring it to be unfair. Most state legislatures in the United Sates have given up or waived some portion of their sovereign immunity. Waiver of some immunity is commonly done for public policy reasons.

Legislatures usually waive immunity by passing laws allowing the courts and other judicial bodies to hear and decide certain kinds of cases in which someone injured by the government is suing for money damages.
