I have heard insurance companys (yours and hers in this example) will share responsablity and "go in" with each other by 50/50 or 30/70 etc. and there for showing a record of you making a claim on your insurance even though it was 100% her fault. Making it possible to raise insurance premimums in the future when shoping for others or making changes to your policy. I have heard of people writing their insurance company to tell them you accept 0% fault on this accident making her insurance pay 100% for your repairs/injurys/etc. Now this is all hear/say but its something to contact your insurance company about just to make sure your not getting pinned with ANY of this B.S.

Exact thing happened to me, rear frame crossmenber was bent, tranny went to $hit, Bed cracked about a foot from the end of it. The lady who hit me was in a 91 Corolla going 70 MPH and i was at 0 MPH on the gridlocked freeway. Took 5 years for the pain to go away.

Trust me on this, your tranny is hosed or will be hosed. Mined died a few weeks after I settled the claim but it was too late. Since then I have gone through 5 tranny rebuilds on a stock truck and 4 HD U joints.

If its not totaled, get a new tranny, rear end and bed and any other suspension thats jacked up.

You will get reimbursed by her insurance company for any work missed. At least i did when i got rear ended.

Same thing happened to me last year, i was already stopped and been there for a bit and bam, woman in a 94 chevy truck hit me at like 50mph... totaled my 06 sierra, i hate stupid people... sorry to hear about that man, hope u and ur girl are ok...

I'm just not sure whether or not to get a lawyer. I'm outta work right now, but i know i'll have to make some trips to the chiropracter etc from now on. Labor intensive work, and i doubt i can pick anything up that heavy right now. I guess i'll have to ask a lawyer. Looking underneath, i can see the leafs were bent forward and the rear end looks twisted but i can only imagine hitting at full speed it had to up shoved it up.

as previously stated. get yourself a good lawyer, and have him stay on the insurance company. if you get an injury claim then you'll have no money troubles for the next few years

i'm not exactly sure what you mean by injury claim, but the doctor already gave me a few weeks off, and i'll be getting x rays soon. I'm guessing if something comes out of this, and a slip disc or something is what you mean by the injury claim. I really hope not, because someones back isn't something that can just be fixed. Sucks. thanks for the help guys.

You need a lawyer bud, the insurance company will try to screw you, trust me, you need a lawyer!

i went thru a month of rehab on my neck after my accident.

Just make sure you keep all records, bills, mileage to the doctor, missed work, ECT so you get paid.

you will also get pain and suffering compensation.

Get a lawyer, dont short yourself.

when i say injury claim, i mean that the insurance will pay for any and all medical bills you have, work you missed, time you spent, etc. and if you're lucky, and your lawyer will probably recommend this, you will get money for emotional distress caused by the incident. that usually means that you'll get a major payout. a guy we know got a seven figure payout from an accident. he now owns a car audio shop in montgomery.

Like the local commercial says "The insurance company has lawyers working on your case, so should you."

IT TOOK ME 5 YEARS BUDDY, to get over the back pain. Have them total it out and buy it back if you want.
