I got to talking to the other insurance today. the lady who hit me insurance, and they were all cool with it. They told me they'd give me a rental and 45 bux for it and also tow it where i wanted. Lady took liability, so my claim adjustor at my insurance said it should be smooth....Yeah, so two hours later guess what....The lady on the other insurance calls and said she's sorry, she can't pay for anything but i can proceed with the process. Said their having problems with the Coverage for the lady that hit me...How exciting is that? can't pay for ****, and now i'm stuck with this bullshit from some olda *** lady in her brand new lexus. Now i have no other vehicle, but the one fucked up in the drive way, yay.

 

This happened to me not 3 months ago. Get a lawyer, and a good one at that. And ditto on the tranny being jacked up!! If it's not done for now it will be in a few hundred miles after your truck gets fixed. Call your insurance company.

 

i smell a lawsuit stay on the company and make sure they pay you what it takes to make the situation right.

 

Your usually not supposed to talk to the other insurance....thats what your insurance is supposed to handle. And if she is trying to pull the I can't pay for it but I drive a brand new lexus then at least talk to a lawyer for their usually free 1 hr advice and state your situation. If the lawyer bites you may have a real case here. Just make sure that your lawyer bill will be footed by the other insurance company.

 

The lawyer would take 1/3 of the cut, and the ladies claim adjustor was giving me the go ahead. Then about 30minutes later she called me back and said she's sorry but there's a coverage issue. She said she'd let me know by the weekend.

 

Any updates on this? I am sorry this happened to you, I think we all have been rear ended sometime or another.... Sucks everytime it happened to me.

 

even if your insurance covers it under uninsured motorist, your rate will still go up, no mater what they tell you. I hope it panned out.

Depending on the amt of the damage:
Take her to small claims
Get a judgement againsts her
Get a Justice of the peace to exercise a writ of execution to pay from her bank acct
Go with a constable ordered by the judge to her bank and they can legally pull the funds out with out the defendant wanting it to be paid.

Well, so far i've been put on disability. I ahve to go through physical therapy for my back. I'm mobile, but i can't do my job. Mid back is kicking my butt. Had some fd up shots down the side of my spine. 16 shots marked down the back, and let me tell you it felt great. It's crazy. I wanna go back to work, but i know damn well I cant do my job. Shitty situation. The ladys insurance came through, and is paying for everything, atleast what the injury person said. All the bills are going to her, and so far taking care of them. I'm hoping to be out of therapy by july. Truck is still in the damn shop. Taking forever, but i rather it be done right, then coming back fd up. So far it's about 12k in damage, and maybe overall 14k in damage. They didn't total, as they put too much into it off the start. Now i have to wait. I wonder what they do for something like this. I did a calculation on the money thing, and it came out ridiculous. I Think, all said and done. i should be around 30k in bills for me. Atleast that. I'm getting no pay check, but i didn't wanna file for disability but i obviously had too. So now, i have to get recompinsated for all of it. I just want my bills paid, and my lost wages. The injury ****, is just a bonus. If they low ball me, then i'll get a lawyer. anyone know how to kind of calculate what I should be looking at for compensation?
