Yea i would go to court. If they toss it which they verywell may then you can sue the class later on when/if you get another ticket like stated above.

I got the same ticket about 6 months ago. It's called "Illegal Start" here in Florida. Basically, you cannot start FROM A COMPLETE STOP in a manner that is unsafe. If you were rolling AT ALL when you passed the other vehicle, then the cop cited the incorrect statute and you are innocent/not guilty.

Go to court. 3 things could occur, with 2 of them better than not going: 1) you are found guilty and are fined AND have points assessed, 2) you are found guilty and are fined BUT no points are assessed (as in my case), or 3) you are found not guilty. Scenarios 2&3 are worth the chance of #1 - so go to court. The points are what will get you over the long run. It's kinda ambiguous as far as laws go anyways. Good luck.

well I definitely was not completely stopped. The garbage truck had moved forward past a median allowing me an area to pass and I took it. the opening is only maybe 150 ft long hence the rush to hurry up and pass him so I didn't have to sit behind the garbage truck for another 2 miles.......

The funny thing was it took him literally 15 minutes and looking thru several books to come up with something to write me for. He even asked me if all my lights were legal?

Something else funny on the ticket he has my vehicle as a chevy sierra......here's your sign. Think I might take this before the judge.

finally found the texas transportation code that applies to this violation. Here it is......

§ 545.402. MOVING A PARKED VEHICLE. An operator may not
begin movement of a stopped, standing, or parked vehicle unless the
movement can be made safely.

biggest problem with me getting this ticket.....I wasn't parked, standing or stopped I was initiating a pass in a legal passing zone. There was no oncoming traffic. Now I know I am definitely going to fight this one.

Anyone care to put odds on me beating this one?

I went to JVHS. I never got pulled over. I guess I was lucky, but I do know that JV cops are asses. Sorry to hear you got screwed, good luck fighting it. If the judge finds you guilty, appeal the ticket. I think that was a B.S. call.

you probably had one of those JV stickers on your car though. They never seem to pull over people that actually live in Jersey Village. They love to nail people driving thru Jersey Village. Talking with a lawyer now. I am determined to not give them one single cent......I would rather see it go a lawyer.

Looks like lawyer will cost $150 for dismissal and 0$ if found guilty. The fine is $192 on the ticket so I might come out ahead.
