sold a car, guy stopped paying, what now?

Default sold a car, guy stopped paying, what now?

posting this for a friend. he sold a 1976 cutless supreme to a "friend" of his for 4000. the guy agreed to pay $500 a month, first month was ok, then he started paying less and less, from $500 to $350 to $200 and now hes only paying $100 a month. no papers were ever signed and my buddy still has the title. he told the guy he was going to pick the car up tomorrow but the guy says he wants his money back that he paid so far, which is around 2k. i told my friend, when the dealership repo's your car do they give you what you've paid so far? so anyways what can he do about this situation? can he just go to the guys house and ask for the keys or should he get the cops involved? thanks

The buyer has no legal recourse. Your friend may repo the car at any time he sees fit. There are no documents showing the buyer is buying anything and legally it appears he has only borrowed it and failed to return it. Not too smart imo.

yeah Im with Bill on this one. no documents and no one wins really. Your friend gets his car back and the guy who renigged gets nothing.

i feel sorry that your freind has to go thru this trouble to get his car back. all he wanted to do was get rid of that car, not hassle with this bs. not to mention i hope that the idiot didnt trash that cutlass

yeah serious, he still has the title there for it is still his car. You can show up, hop in and drive off. I'd be safe about it tho. maybe 2 people incase he wants to get froggy, think if someones about to steal your 1970 Cut Supreme...
