I dont know which pcm they used because it took time to find a 2010 pcm , I sent it to a friend in Saudi Arabia who will flash it with a 2009 tune and try it before he sents it

With the E38, only an 07 calibration can be flashed into an 07 ECM, 08 into 08, etc. IF it is a 2010 ECM (service number ends in 238), then that is probably not your problem. If it ends in 455, then that is a 2009 ECM and it is probably dead.

Where are you located? I was assuming in the US, in which case Id tell the dealer youll sign the contract releasing them from warranty, when they sign one saying that they are knowingly disregarding the magnuson moss act.
No matter what they put in writing, or in print, they are not exempt from following laws. Its a scare tactic.
Magnuson moss states that to be denied warranty work, they have to prove that the specific modification that voided warranty is what caused the failure.
In other words, say you tune your truck, and burn up a transmission. They have to prove that they have never had a transmission burn up in a truck that hasnt been tuned.
I smoked a transmission in my 08 with a 4.8, took it to the shop with LT headers, and the tune in it, and had absolutely no issues with them warrantying the repairs. The only call I received was to inform me I could pick my truck up.

the papers say that by agreeing the engine, trans and the differential warranty will be removed, i guess il have a little chat with them on sunday while taking it for service

ls3edit is set default to lock them. And everything was locked for a short time.
Don't know what pcmperformance is using but this was an issue when only they could access ls3 ecu's. HTH Dealers CANNOT overwrite ls3 locked files unless something has changed. Seed/key routine is altered.
