California Is Tricky but you can still get around it legally. As mentioned if the car was equiped with it, It needs to be there for the Visual Inspection. You can however disable it in the tune as mentioned.
You can also go to a State Smog Ref and have it Legally re-certified for the newer engine without the EGR and Air injection. They will affix a new label saying that it has been recertified to those standards.
Neither of those 2 peices affect the out put of the emmisions durring the Smog test.
The AIR Injection only runs during start up and the car needs to be up to full operating temp before testing.
The EGR doesn't even come on until light throttle cruiseing around 45 - 65MPH. The testing is at Idle, 15mph and 25 mph

I had my EGR tuned out of mine, still haven't bought the block off plates for it though.
Sounds like what you need to do is get the block off for the exhaust side, get a tune to get rid of EGR in the computer, and then get it recertified as a non-EGR/AIR vehicle.
